The following is a brief case analysis of the case titled Mrs. Valsamma Paul V. Cochin University and others, AIR 1996 SC 1011, 1996. The Court, in this case, had stressed on the fundamental right to equality enshrined in the Constitution of India which, however, envisages equal access to education and employment, reserving the disadvantaged sections of the community that are not fairly addressed in the affairs of the Nation.

Because of the very purpose that they have not experienced a lot of drawbacks and limitations as the forward community, people who are accepted by the weaker sections as a member while belonging to the forward community might not even be allowed to seek privileges of the lower caste and also to award them these incentives will only contribute to the violation of the core tenets that our Constitution strives towards for.

The Constitution is centered on secular values and socialism, which helps to understand that democracy will not thrive until fair services and incentives are given for all segments of society to engage in political governance, regardless of caste, ethnicity and gender.

As a forward caste representative to qualify himself to the reservation, the simple acceptance of the group in that caste is just not enough.
