The case Union for Civil Liberties and another v. Union of India and another with Lok Satta and others v. Union of India is one of the leading cases in the Right to Information Act, 2005 as it acts as a precedent decision for the courts. The case put forwards a question mark on the constitutional validity of section 33b of the Representation of the people act as the parliament ignored the fact that an election process is to be transparent and fair to constitute an effective democratic system and nullified the decision of the court by inserting a new amendment i.e., section 33b for its own benefit. The case also puts forward the fact that misuse of powers by the legislature is one of the biggest reasons of a perverted and polluted democratic system in our country. The following paper provides an insight on facts, issues, arguments and final judgement of the case with a conclusion drawn by the author. The paper also highlights a brief of few precedent decisions taken by the Supreme Court and High Court.
