The following is a brief case analysis of the case titled Central Public Information Officer, Supreme Court of India v. Subhash Chandra Agarwal (civil appeal no. 10044 of 2010). This case comes under the purview of right to information [Section 2(j)] and it also determines the balance between the right to information guaranteed and the principle of confidentiality. This case moreover focuses on the transparency in the government institutions regarding the disclosure of information related to appointment of judges and the personal assets of the judges. This case has been read, summarized and analyzed broadly under the following headings: facts of the case, issues at hand, arguments from both the sides, legal aspects involved and overview of the judgment. In this case an RTI activist seeks transparency in the matter of declarations of the assets held by the judges as this transparency is in the interest of the public and any information in the interest of public should be disclosed. Along with which it is also seen in this case that any power should be used to create something good in the society and shouldn’t be misused, similarly any information disclosed to the public at large should also not be used for any other wrong purpose.
